LPA Receivership

Representing and recovering the interests of lenders

Fixed-charge receivership, property receivership or Law of Property Act receivership (LPA), is a highly specialist service provided by Vail Williams, where the secured property assets of lenders have become compromised by mortgage arrears resulting in the need to appoint an LPA Receiver.

From the outset, our experienced and fully qualified receivers – Matthew Samuel-Camps and Russell Miller – look to identify the best strategy for the individual circumstances. This takes years of experience, in-depth legal knowledge and a determined and high quality approach. We always look beyond our legal obligations to explore opportunities to increase the value of the charged asset to maximise recovery. As part of this process, we are very aware of the duty of care owed to the borrower and other third party creditors.

Our approach is flexible and tailored to the individual requirements of each lender. The receivers oversee all projects and adopt a very ‘hands-on’ management style.  We consider all options to maximise realisation, often taking a longer term view to ensure the best possible outcome.

Matthew Samuel-Camps and Russell Miller are both Registered Property Receivers and members of NARA – The Association of Property and Fixed-Charge Receivers.
