Challenge

Spirent Communications plc, the leading global provider of automated test and assurance solutions for networks, cybersecurity, and positioning, appointed Vail Williams to provide expert advice in relation to a dilapidations claim from their landlord.

Our building consultancy team was appointed to advise on and achieve a substantial reduction in the landlord’s dilapidation claim at lease break, with the break conditional on payment of principal rent.

How we helped
  • Carefully reviewed landlord’s claim, establishing several areas where inflated costs or losses were present.
  • Based on expert knowledge of dilapidations claims, our building surveyor successfully negotiated down the claim.
  • We discounted several of the landlord’s claims including the rent claim, because the unit was in good condition and only minor repairs were identified.

Areas where a reduction in the landlord’s claim was secured, included:
    • The landlord claimed for £30,000 in loss of rent. This was refuted on the basis it could only apply if remedial works were carried out by the landlord.
    • The landlord made a reinstatement claim for alterations made by the tenant. These were largely discounted, as most occurred under a previous lease. As the changes were not identified in the new lease, they became the landlord’s fixtures.
    • Whilst our client had to keep these in good repair, we saved them approximately £28,000
    • The landlord claimed £68,151 to undertake repairs. We found this to be excessive and successfully reduced this to £14,395, a saving of 79%.
    • We also negotiated a saving on decoration claims, achieving a discount on the landlord’s original cost of £7,000.
Results
  • Overall, our building surveyors negotiated a £121,000 reduction (63% saving) in the landlord’s dilapidation claim.
